GENERAL TERMS AND CONDITIONS

Art. 1 – STANDARDS AND INFORMATION
These regulations set out the terms and conditions for course registration as well as the rights and obligations of participants in MTC-Training & Consulting courses under the brand name GSM, PMP-Training. After registration, the accepted candidate receives a confirmation containing the details of the course.

Art 2 – ADMISSION
Only participants from the class list who have paid the registration and tuition fees are admitted to the course.

Art 3 – PAYMENT
An application fee, may be charged for classroom coursers mentioning it, CHF 60.- (CHF 150.- with Visa / Student Permit). This amount is not refundable. Lessons must be paid in full before the start of the course. Management can grant payment by installments.
Schooling includes lessons. Excluded are: course materials (unless otherwise stated), examination fees, insurance charges.

• Cash, bank / postal transfer

Art. 4 – DELIVERY

Courses are delivered online, with or without an instructor, and in person at MTC’s premises or at the client’s site.

Art 5 – CANCELLATION OF THE COURSE BY THE PARTICIPANT
Any course cancellation must be announced in writing. For notified cancellation: 25 days before the start of the course, 100% of the paid tuition amount will be refunded. Between 24th and 11th day a deduction of 1% per day will apply. From the 10th day before the start of the course, 100% of the paid tuition will be credited to the participant’s account for 6 months. After this period, no refund will be granted. The special conditions apply in the event of force majeure.
No reimbursement is due once the course has started, for non-participation in the course, for dropouts, absences or interruption of the course, for lessons coinciding with Easter, Ascension, Whit Monday, August 1, and the Geneva Jeûne Genevois. A private lesson can be canceled 24 hours before the scheduled time or according to the agreed conditions.

Art 6 – CERTIFICATE, DIPLOMA
A certificate of attendance at the course is issued for a minimum participation of 80%. Participants who have successfully passed the final test receive a Certificate. No certificate will be issued in the event of:
• Non-payment of the full course price.
• If the course participation is less than 80% (except absence in case of force majeure).

Art 7 – CANCELLATION BY MTC
Management may at any time close or cancel a course for internal reasons. The student will be entitled to full reimbursement or pro rata for lessons that have not taken place. No refund is due for a course suspended or moved in time.

Art 8 – MATERIAL, RESOURCES, SOFTWARE AND DATA, Classroom training
Users must keep the equipment and documentation at their disposal in good condition. The IT resources can only be used in the context of learning actions related to the course. Any copying is prohibited. In the event of material damage, the person responsible will be required to repair the damage. The purchase of civil liability insurance is recommended.

Art 9 – DAMAGE, LOSS OF OBJECTS, Classroom training
MTC declines all responsibility for any damage to property or theft that may occur on its premises.

Art 10 – CHANGES TO PROGRAMS AND PRICES
The management reserves the right to make changes to the programs, prices and Terms &l Conditions without further notice.

Art 11 – JURISDICTION and VENUE.

Any dispute, controversy or claim arising out of or in connection with this contractual relationship, including the validity, nullity, breach or termination thereof, shall be subject exclusively to Swiss law. It shall be resolved by arbitration in accordance with the Swiss Rules of International Arbitration 2012 (Swiss Rules 2012) of the Swiss Chamber’s Arbitration Institution in force on the date on which the Notice of Arbitration is submitted in accordance with these Rules.

The seat of the arbitration shall be in Geneva.
